Survey Field Work 

Dear Property Owner,

The Massachusetts Water Resources Authority (MWRA) has an ongoing program for the rehabilitation of our sewer system to improve the reliability of service to our customers. As part of this program, the MWRA plans to rehabilitate its Sewer Sections 41, 42, 49, 54 and 65 in Malden and Melrose, Massachusetts with a cured-in-place-pipe (CIPP) liner system. The Contractor will need temporary access on a portion of the referenced property to complete the CIPP lining process and temporarily bypass wastewater flows. The CIPP lining work is not anticipated to begin until Spring 2025 and will be completed within a 2-year contract period. However, the work on the referenced property will only last 2-3 weeks in total within the 2-year period. You are receiving this letter as the property owner of the above referenced property. Please notify all tenants of the upcoming work.

CIPP lining is a trenchless technology where a flexible tube is inserted into the existing sewer through an existing manhole and steam cured to bond to the existing pipe.  This lining system will provide a new joint less sewer pipe that minimizes root and water infiltration problems, improves flow, and provides for a more structurally sound pipe without the need for excavation. Failure to rehabilitate the pipe could lead to pipe failures causing much larger loss of service and interruptions in the future.

MWRA’s consultant, Kleinfelder of Boston, and their subconsultant, Feldman Geospatial, will be performing survey fieldwork on your property to determine the metes and bounds of a temporary access area while we are in the final design phase of the project. The survey work is estimated to begin mid-April, however the survey crew may be on the referenced property any time 6 weeks following the start date for a total of 1-2 days. The survey crew will consist of 2 or 3 people who may utilize tripod type setups with survey instruments to perform the survey.

Please find attached a copy of Chapter 770 of the Acts of 1987, Section 15. This legislation provides that authorized agents and employees of the MWRA may enter upon your land for the purpose of survey field work.  Prior to entering your land, the MWRA must give you and the Municipality where the land is located 15 days’ notice of its intent to enter your land, and to provide for the payment of just compensation for such entry.  Please consider this letter to be your notice of MWRA’s intent to enter your property to perform survey field work in support of the Interceptor Renewal No. 7 project.

MWRA believes that $100.00 represents just compensation for the privilege of entering said land and performing survey work. A check payable to you in the amount of $100.00 is being advanced under separate cover. If you believe this amount is insufficient to provide just compensation, you may petition the Massachusetts Superior Court to have the amount increased.
